Italian marriage certificate

A marriage registered in Italy is attested by the certificate, the extract or the full copy of the record. The Firm requests these from the town hall in which the marriage was celebrated or transcribed, and also assists with the transcription in Italy of marriages celebrated abroad.

Certificate, extract and full copy

• Marriage certificate: sets out the essential details, namely the names of the spouses and the date and place of celebration.
• Summary extract: sets out the details of the record and the marginal annotations, such as the choice of matrimonial property regime (community or separation of property), legal separation or dissolution of the marriage.
• Full copy: reproduces the record in full, with all annotations. It is issued only to persons who demonstrate a direct and concrete interest (art. 107 D.P.R. 396/2000).

Multilingual extract (Form B)

The multilingual extract of the marriage record is valid without translation or legalisation in the States party to the 1976 Vienna Convention, including Spain. Between Member States of the European Union, moreover, public documents are exempt from the apostille (Regulation (EU) 2016/1191). For use in third countries, the Firm arranges for the apostille to be affixed by the Prefecture.

Transcription in Italy of a marriage celebrated abroad

A marriage contracted abroad by an Italian citizen must be transcribed in the civil status registers of the competent Italian town hall. Without transcription, the civil status of the person concerned is not updated in Italy, with possible consequences for other procedures, such as the issue of passports to children or successions.

The application may be submitted to the competent consulate or, for persons registered with AIRE, directly to the town hall. The Firm handles the matter in either case.

• Marriage celebrated in Spain or in another EU Member State: full-text and multilingual marriage certificates (certificado literal and plurilingüe), and the spouses' identity documents. The Libro de Familia is not an acceptable document.
• Marriage celebrated in a State outside the EU: full record bearing an apostille (or legalisation) and an official translation into Italian.
• Same-sex marriage: transcribed in Italy as a civil union (Law 76/2016).

Documentation required

• Copy of the passports of both spouses.
• Date and place of celebration of the marriage.
• Indication of the Italian town hall in which the marriage is registered or is to be transcribed (as a rule, the family's town hall of origin).

Timescales

For the certificate: digital copy in approximately three weeks, original in 30–60 days. For transcription, timescales depend on the consulate and the town hall; the Firm keeps the client informed of the progress of the matter.
